In order to provide you with the most powerful and safe online experience, RPh LABS, INC. has adopted the following Privacy Policy (“Privacy Policy”).
 

Welcome to RPh LABS, INC.’s website (“Site”)! This Privacy Policy outlines our data collection and usage practices. By using our Site, you agree to the terms of this policy. Make sure to review the complete Privacy Policy. Throughout this document, we may refer to ourselves as “we” or “us,” and to you as “you” or “user(s).” Our policy applies to all websites, including hello@RPhlabs.com, products offered by us and our affiliates, and any related services (collectively, the “Services”). Products such as the Pharmacogenetic (PGx) Testing Kit will be collectively referred to as the “RPh LABS, INC. Tests.” Our goal is to provide a clear understanding of how we collect, use, store, process, and transfer your information while using our Services. 

By using this Site and our Services, you acknowledge all of our policies and procedures described in this Privacy Policy and our Terms and Conditions. If you do not agree with or are not comfortable with any aspect of this Privacy Policy or our Terms and Conditions, you should immediately discontinue using our Site and/or Services. 

Definitions of key terms 

Information that has been combined with that of other users, analyzed or evaluated as a whole, and cannot reasonably be linked to an individual. 

Information from which your registration details (such as your name and contact information) and other identifying data have been removed, so that you cannot reasonably be identified as an individual. 

Information about an individual’s genotypes, but not necessarily related to registration information. 

Information about you that can be used to identify you, either alone or in combination with other information. RPh LABS, INC. collects and stores the following types of information: 

When you register for and/or purchase our Services, you provide us with information about yourself (e.g., your name, email address, address, user ID and password, as well as your payment information). 

Information about your genotypes generated by RPh LABS, INC. or its affiliates, contractors, successors or assignees; or otherwise processed or contributed by RPh LABS, INC. 

Information you provide directly to us, including but not limited to current medications you may be taking, ethnicity, gender, age, and other information you enter into surveys, forms, and features while logged into your RPh LABS, INC. account. 

The term “sensitive information” refers to information about your health, genetic information, and certain self-reported information, such as your race, ethnicity, and sexual orientation. 

Information, data, text, software, music, audio, photographs, graphics, videos, messages, or other materials generated by users of RPh LABS, INC. (except genetic information and self-reported information) is considered User Content. RPh LABS, INC. services and transmitted to or through it, whether publicly or privately. 

Information collected through log files, cookies, web beacons, and similar technologies (e.g., browser type, domains, page views) about how you use RPh LABS’s services. 

The information we collect 

RPh LABS, INC. collects personally identifiable information such as your e-mail address, name, home or work address, telephone number, and other information that you may provide to us, including but not limited to services you are interested in or medications you may be taking. Additionally, RPh LABS, INC. collects anonymous demographic information, which is not unique to you, such as ZIP code, age, gender, preferences, interests, and favorites. 

When you use our Site (our website, products, and other services), we collect Web-Behavior Information through cookies and other similar tracking technologies. 

RPh LABS, INC. also collects information you directly provide. As a result of placing an order, creating an account, completing research surveys, contacting RPh LABS, INC., or being contacted by RPh LABS, INC., we collect and process your information. Information collected by RPh LABS, INC. can be divided into Registration Information, Self-Reported Information, and/or User Content. 

Through DNA testing services offered through the Site, RPh LABS, INC. or its affiliates, contractors, and assignees may collect information. In order to provide you or your doctor with the results for the ordered product, we or our affiliates will extract your DNA from your Test Kits and analyze it to produce your Genetic Information. 

We use information in the following ways 

Personal Information is generally processed for the following reasons: 

  1. In order to provide our services, we process Personal Information. As part of our Service, we process payments, ship kits to you or your doctor, create customer accounts and authenticate logins, analyze buccal swab samples and DNA, generate test reports, and deliver results, among other things. 
  2. In addition to improving and providing new reports, tools, and Services, we may have to fix software bugs, analyze use of our website to improve the customer experience, or evaluate our marketing campaigns. 
  3. We use third parties, such as network advertisers, to serve advertisements on third-party sites or other media (e.g., social networking websites). 
  4. We may use your personal information to respond to your questions or to contact you regarding news, updates, educational material, or in connection with our Services.
  5. As Required by Permitted Law. We may use your personal information to comply with any legal or regulatory obligations, or for any other purpose allowed by law or with your lawful consent. In order to de-identify your personal information, we will remove information that could reasonably be used to identify you.

Information Access 

To allow us to provide you with our services, we may share your Personal Information with our service providers and third party vendors. 

We will never sell, lease, or rent your identifiable individual information to a third party without your explicit permission. 

Information Security 

In compliance with applicable laws, RPh LABS, INC. implements reasonable and appropriate measures to maintain the confidentiality, integrity, and accessibility of its data. We use encrypted technology to connect to and from our website, where data is collected and exchanged. We also ensure that all collected data is securely stored in accordance with HIPAA and other healthcare laws and regulations. 

Third-party information sharing 

As part of our commitment to providing our Services, we work with third party service providers who assist us in various aspects of our operations. These providers help us to deliver, evaluate and enhance our Services, and we may share the necessary information with them to fulfill our contractual obligations to you. Although most data processing tasks are handled by RPh LABS, INC., certain areas may be supported by these third parties, as outlined below. 

Our cloud storage providers are responsible for securing information in our RPh LABS, INC. databases, ensuring uninterrupted service for our customers, and safeguarding data during unforeseen events. Please note that these providers act on our behalf. Additionally, we have established procedures and contractual agreements with each provider to maintain the confidentiality and security of your information. However, please keep in mind that there are inherent risks associated with electronic storage and transmission of data and we cannot guarantee complete confidentiality and security. 

We may share Aggregate Information with third parties, which is information that has been stripped of your name and contact information and combined with information from others, so that you cannot reasonably be identified. Since this information does not identify or disclose any individual’s data, it is not Personal Information, unlike “Individual-level” information. 

Sharing information with other companies under common ownership or control of RPh LABS, INC., including our subsidiaries and affiliates, is essential for us to enhance your service and improve your overall user experience. This may involve sharing some or all of your Personal Information. As part of our contract with you, we may need to share this information. However, if we plan to share your Personal Information with our commonly owned entities in a significantly different manner than described in this Privacy Statement, we will give you advanced notice and seek your consent beforehand. 

Under certain circumstances, your Personal Information may be subject to processing in accordance with laws, regulations, or government requests. RPh LABS, INC. will disclose information if required by law or if deemed necessary to comply with legal or ethical obligations, enforce our policies, address claims of third party rights violations, or protect the well-being of our company, employees, users, clients, and the public. 

In the event that RPh LABS, INC. undergoes a business transition, such as a merger, acquisition by another company, or sale of some of its assets, your Personal Information may be transferred as part of the transaction. The promise made in any pre-existing Privacy Statement would continue to apply to your information in such a case. 

We may partner with third-party advertising networks to manage our advertising on other sites. We may also share information about you with third parties only in ways expressly stated in this statement. By doing this, these third parties can serve ads directly on our behalf on their websites. 

Safety 

At RPh LABS, INC., we value the trust you have in us. To maintain accuracy and proper use of information, we utilize various reasonable technical, physical, and administrative measures to safeguard your Personal Information. Rest assured that our methods are in line with current technological standards, as well as compliant with applicable HIPAA and GINA requirements. While we make every effort to protect your personal information, we cannot guarantee its complete security. 

RPh LABS, INC. may store and process your information in the United States or in any other country where it operates. As a result, your information may be subject to the laws of other jurisdictions, which may differ from those in your country of residence, if the company, its subsidiaries, affiliates or service providers maintain facilities there. 

Information Regarding Your Personal Information 

Depending on where you live, you may have additional privacy rights for your Personal Information. For instance, if you reside in California, you may be entitled to certain privacy rights under the CCPA and other relevant laws. It is important to note that state privacy rights do not cover all types of Personal Information, such as PHI, which may be safeguarded by HIPAA and other similar laws.

We may revise this Privacy Policy from time to time as new features and services are added, laws change, and security and privacy best practices change in the industry. In order to make it easier for you to know when a change has taken place, we display an effective date in the upper right corner of this Privacy Policy.
